Resisting Arrest With or Without Violence

This charge comes in two forms: resisting arrest with violence and resisting arrest without violence.

A person does not have to do much to be charged with resisting arrest. For example, many people are charged with resisting arrest for refusing to immediately sign their ticket. Essentially, anything outside of immediately giving up and doing exactly what the police officer requests could lead to a charge of resisting arrest.

The charge of resisting with violence can be applied just as easily. For example, the police may arrive on the scene of an altercation. In an attempt to make a bar fight arrest, an officer may get hit. Although no violence was intended toward the officer, the alleged attacker may be charged with resisting with violence, in addition to the primary charge.
